Essential information we collect
In operating our store, it is essential for us to capture some information about your device, such as your IP address and information related to your visit when you browse our store. For example, this might include time-stamp, the last page or product you visited, the indication that you logged in.

Order information you expressly provide
If you buy something from our store, we will need more specific information about you. To fully process your order and ship the merchandise you selected, we need your personal data such as your first and last name, your email address and your shipping and billing address. We also use your contact and order information to send you communication related to the processing of your order. We will ask you to provide this information in our “checkout page” before letting you finalize your purchase with the payment.
Accounts
You can sign up for an account if you’d like. This will make us happy because it confirms your interest in our store. It should also make you happy because we will remember your information and, when you decide to buy our products, you do not have to provide all of your information over again -- you just have to log-in. Before registering your account, we will ask you to expressly provide your consent to this privacy policy. Only if you give us your consent, we will open your account. Reviews
If you have completed a purchase, we will send you an email to ask you to review the product you bought. We want to be sure that whether you love your purchase or have a complaint, you can share your opinion with other customers.

We also use some specific information related to your visit, such as the timestamp of your visit, the page or the product you viewed, where you are coming from (if you came to our store because you clicked on an advertisement or you just opened our direct link). This is very similar to the “essential information,” but we use it to provide you with a personalised experience. The information on your visit provides us with insights on your interests and allows us to send you relevant communications. We capture this information through cookies, called a "beacon," that we allow you to block. If you do not wish us to use cookies then please do not use our website.
How do we process your information?
We use an external provider to run our store, BigCommerce. BigCommerce is based in the US and is a participant in the EU-US Privacy Shield Framework and committed to providing best-in-class service and data protection. You can check its participation in the Privacy Shield here on the official site of The International Trade Administration (ITA), U.S. Department of Commerce. Through BigCommerce, we also use other, highly specialized external providers to provide the most competitive services. For example:
● Payment: Our store is PCI-DSS compliant (a very strict industry standard with requirements for the security of credit card information), but we want to use accredited companies to process your credit card information which is why we use PayPal and Stripe UK.
Partnering with highly specialized external companies allows us to focus on what we do best: selling great products.
How can you control your personal data?
If you are one of our customers who is in the EU, and we are specifically selling our products to the Member State where you are located, you have specific rights that we are honored to enforce without undue delay: Access, Correct, Erasure, Port, Object. How long do we keep your data?
We keep your data for as long as you have an account with us. We also keep some data for security investigation. Most importantly, we have specific obligations for fraud detection and tax reasons. Therefore, we might need to retain certain data even if you ask to delete it.

IT IS ILLEGAL TO SELL CATEGORY F2 FIREWORKS OR CATEGORY F3 FIREWORKS TO ANYONE UNDER THE AGE OF 18.
IT IS ILLEGAL FOR ANYONE UNDER THE AGE OF 18 TO POSSESS CATEGORY F2 OR F3 FIREWORKS IN A PUBLIC PLACE.
1. Definitions
The Company = POB's Pyro Ltd.
The Customer = any person(s) or organisation the Company supplies Goods to.
The Goods/Order = all materials and items supplied by the Company to the Customer.
2. Application of terms
2.1. For general use of this website, only Conditions 9 to 14 need apply.
2.2. An Order placed with the Company are subject to all of the following Conditions:
3. Price
3.1. The Price of a product shown on the Company's Website is in Great British Pounds (GBP, Sterling £) and is inclusive of all the relevant taxes.
3.2. The Price is valid until such time as amended by the Company. The Company reserves the right to amend the Price at any time at the Company's sole discretion and without being responsible for any form of loss.
3.3. The Company shall endeavour to ensure all Prices are accurate, however in the event of a clerical or typographical error or omission relating to Price on the Company's Website, acceptance of Order, invoice or any other document issued by the Company shall be subject to correction without liability on the part of the Company.
4. Contract
4.1. The Company supplies category 2 and category 3 firework Goods tested to conform with BS EN 15947 via online retail on the Company's Website, www.pobspyro.co.uk, or at a physical retail outlet such as a shop, stand or stall.
4.2. A Contract shall only exist when an Order has been placed by or on behalf of the Customer in accordance with this Contract. A Customer may place an order on the website, or alternatively by phone or in person.
4.3. While the Company will endeavour to ensure Goods details on the Company's Website, including descriptions, dimensions, images, weights and product videos are accurate, at all times such details are to be used only as a guide and do not form part of the Contract. The Company will not be held responsible for any variation of the same nor have any liability in respect of such variations.
4.4. Fireworks are an aged restricted product and therefore by law the Customer must be over 18 years of age to place an Order. By placing an Order they acknowledge this and the possibility of being asked for photo ID for age verification purposes.
5. Product availability
5.1. The Company will endeavour to keep stock availability kept up to date at all times.
5.2. If a product is shown as available on the Company's Website yet is actually out of stock, the Company will contact the Customer to discuss a suitable alternative of equal or greater quality and price. When the Customer collects their Goods they will be notified of any product substitutions.
5.3. Should the Company supply substitute Goods without prior agreement by the Customer, the cost of returning any unused substitute Goods to the Company in the event of cancellation by the consumer would be met by the Company.
5.4. Due to the manufacturing process the design, make-up or materials of the Goods may change from time to time.
6. Payment
6.1. The Company supplies the Goods to the Customer and the Customer shall pay the Price of the Order. The Company shall retain title and ownership of the Goods until:
(i) the Price and all other sums outstanding by the Customer to the Company are paid in full and either;
(ii) the Goods are signed for by the customer after being delivered or;
(iii) the Goods are collected by the Customer from the office address of the Company.
6.2. For orders placed on the Company's Website, payment of the Price shall be paid by the Customer to the Company either:
(i) at the time of the Order, in which case the Company accepts most major debit and credit cards.
(ii) or cash payment on collection, provided that the Price of the Order is paid in full by the Customer on collection of their Goods or 30 days from the date of the invoice, whichever is sooner. Failure to do so could result in the cancellation of the Order by the Company.
6.3. An Order must be paid for in full prior to delivery.
6.4. The minimum Order amount is £30. Should the total Order value be less than £30 then the Customer will be charged the minimum Order amount of £30 unless otherwise agreed in writing with the Company.
7. Risk and Insurance
7.1. The Risk of the Goods shall pass to the Customer immediately upon collection of their Goods and the Customer will ensure they have adequate insurance cover for the Goods in their possession.
8. Collection, Delivery, Cancellation and Returns
8.1. If collecting their Order, the Customer must collect all Goods at a date and time mutally agreed by Customer and Company prior to collection from the Company's registered office address.
8.2. The Customer may cancel their Order for any reason up to the point of collection or dispatch and any payments made by the Customer shall be refunded in full, minus any fees associated with processing the refund (i.e. 2% of the Order value for credit cards), within 14 days.
8.3. On collection of their Order, the Customer shall bring with them the order confirmation email and highlight any damage or shortages in Goods at the time of collection.
8.4. On collection or delivery of an Order the Customer must be over 18 years or age to receive the Goods and photo ID may be requested to verify age.
8.5. For anti-fraud and age verification reasons the Company can only deliver to the Customer that placed the Order.
8.6. Following an Order being placed by the Customer, the Company shall contact the Customer to mutually agree a delivery date and approximate time for delivery. Should there be no-one over the age of 18 to sign for the delivery at the delivery address at the mutually agreed date and approximate time of delivery, then the Customer shall be liable for the cost of further delivery attempts.
8.7. The Customer shall inspect the Goods upon receipt of delivery and must notify the Company by letter or email within 14 days if the Goods are damaged or if they wish to cancel their order. If the Customer fails to do so then the Customer shall be deemed to have accepted the Goods.
8.8. Where a claim of defective or damage is made, the Goods shall be returned by the Customer to the Company within 14 days of receipt. The Customer shall be entitled to a replacement or a full refund of their Order (including delivery costs) if the Goods are defective.
8.9. The Customer has a duty to take reasonable care of the Goods while in the possession of the Customer. The Goods must remain unused and in their original packaging, however the Customer may open the transport packaging to inspect the Goods.
8.10. The Company shall not accept damaged or defective goods where in the Company's reasonable opinion the Goods have been mis-used, damaged or destroyed by the Customer, or stored inappropriately by the Customer which may have affected the Goods condition and performance at the time of use.
8.11. For a cancellation, the Customer has an obligation to notify the Company and return the Goods within 14 days of cancellation. Following satisfactory receipt and inspection of the goods, the Company will refund the Customer the monies paid for the Order, minus return delivery costs, within 14 days, provided that the Goods are returned to the Company and the Goods are in their original unused state. Please note that it is illegal to send fireworks through Royal Mail an unlicensed courier.
8.12. The Company reserves the right to cancel an Order at any time should the Company judge the Customer to have placed an Order with false or fake details. The Customer will be entitled to a refund minus any fees associated with processing the refund if attempting to order from outside of the UK or if the Customer supplies false or fake details.
9. Liabilities and Indemnities
9.1. Except for Conditions outlined in the Contract, and where death or personal injury has been caused by the Company's negligence, The Company and its employees will not be held liable for any damages including, but not limited to, loss of business, loss of profit, damage to property or personal injury of the Customer or third-party in any case, arising from the use or content on the Company's Website, Websites linked to or from the Company's Website, or in connection with any failure in, defect of or damage to any part of the Goods supplied by the Company.
10. Intellectual Property Rights
10.1 The Company retains the property, copyright and any other rights available in relation to designs, content and any other literature prepared by the Company.
10.2. The Customer may print, store and display content purely for their own private use only.
10.3. The Customer may not modify, distribute or reproduce any content on this Website or supplied by the Company.
11. Privacy Policy
11.1. Data collected by the Company will be used to complete the Order placed by the Customer. The Company will not disclose Customer information to third parties.

12. Complaints
12.1 If a customer has complaints about the Goods supplied by the Company the Customer will contact the Company via one of the means below:

13. Severance
13.1. If any court or competent authority finds that any provision of this Contract (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this agreement shall not be affected.
13.2. If any invalid, unenforceable or illegal provision of this Contract would be valid, enforceable and legal if some part of it were deleted, the parties shall negotiate in good faith to amend such provision such that, as amended, it is legal, valid and enforceable, and, to the greatest extent possible, achieves the parties’ original commercial intention.
14. Jurisdiction
14.1. The Customer and Company in this Contract agree to these Conditions and Contract of which they form and shall be construed in accordance with English law and the Customer hereby submits to jurisdiction of the English Courts.
It is illegal to sell fireworks to anyone under the age of 18. It is illegal for anyone under the age of 18 to possess fireworks in a public place. Therefore fireworks must be signed for by someone over the age of 18 on collection and photo identification such as driving licence or passport may be required.
